Property Rights

Government Has Gone Too Far

Every American landowner, urban or rural, is in a war
For their very livelihood, freedom and survival.
Eventually, "Lord USA" will own or control all the land,
If American property owners stand down!
Either fight back or become a feudal serf and slave
To the Lord USA's "Deep State" sovereign domain.

Lord USA

"The brutal reality is that only a ground swell of national rural outrage will reverse the course of socialism and environmental extremism in America and return us to a Constitutional Republic. Farmers, ranchers and rural landowners are the closest to our roots of freedom and can and should be the catalyst to incite that outrage. Rural landowners are being required to bear almost the entire burden of environmental protection, while city folk get off scot-free. Sadly, the environmentally brainwashed city folk don't care that rural landowners must carry that burden. But American landowners own the 'land' and the 'land' is their power, if they will use that power ……. before they lose it."

Forget everything else, except your family, your home, your crops, your livestock
and preserving, protecting and defending property rights.
Start a "Constitutional Property Rights Federation" Chapter - (see below)
In your county and mount a challenge against the unconstitutional
Abuse of landowners by government and environmentalists.
We either defend property rights or we lose them.

The big mega-landowner producers won't help you.
They have joined forces with the government and the environmentalists.

Mega Farm

As an example, the World Wildlife Fund (WWF), a powerful and influential international environmental group, has partnered with the American Cattle Industry. The rules for participation are so onerous, they drive the small cattle producers out of business.

WHAT GOVERNMENT AND ENVIRONMENTALISTS WANT!

The environmentalists want to cram all humans into big cities
where they can be more easily controlled and wall off the rural areas
for the plants, trees, animals, birds, reptiles and insects.
Humans are to be relegated to 25-story buildings in high dense urban cities
and walk, or take mass transit, or their bicycles to work.
Cars, the last bastion of the American freedom of movement, are to be discouraged.

Government and the environmentalists are forcing you
To live in large apartments in dense cities, or in houses with no yards.
They are driving rural residents into large cities containing
Congestion, high noise levels, high crime and high prices for everything.
How would you like to live in this city?

LANDOWNER HORROR STORIES

Stories of government and environmental abuse of landowners abounds. Take the family in Idaho that wanted to build their home on a legal building lot. They started to clear the lot in preparation for the foundation. The Environmental Protection Agency (EPA) came along and slapped them with a compliance order that had a penalty of $37,500 per day. They had to go to the U. S. Supreme Court to seek redress.

Take the Wyoming rancher that built 3 stock ponds on his land. He had all the necessary permits for the project. Along comes the EPA and fines him $37,500 per day for violating the Clean Water Act. The total fines came to $16,500,000 before he too had to take his case to the U. S. Supreme Court. Yes, he won, but he received no compensation for his time or emotional distress.

Then there was a rancher in Nevada whose cattle were rounded up by the government and sold at auction, even though the cattle had every right to be on the land they were grazing. After a 24-year fight in court, they had to abandon their case and sell their land, even though a U. S. Claims Court had awarded them a $14,000,000 settlement that the landowners never received.

A Georgia man and his son obtained the permits to fill in a small portion of their waterfront property. The Army Corps of Engineers came along and charged them with filling a wetland. In court, the judge would not allow the landowner to present his lawful permits to the court and the man and his son were sentenced to 21 months in a federal prison, plus restoration of the property.

Another man in Washington State started clearing out a ditch on his property. The local authorities charged him with digging in a wetland, but they had to declare the land a wetland after he did the digging. The government literally created a crime where there was none before. The man spent 150 days in jail and fined $20,000. It broke him.

We could tell many more stories but the above stories should get the point across. Government and the environmentalists are not going to let rural landowners live in peace and they are going to regulate them out of business, or out of the free lifestyle that comes from living rural. Property rights almost have no meaning anymore. Your property rights are what the government and the environmentalists determine them to be. Property rights are no longer constitutionally protected and unless rural landowners draw a line in the sand, property rights will be a faded paragraph in some old history book.

The overriding theme throughout this effort
to protect American property rights is:

Government Has Gone Too Far

The hard fact is, the U. S. Supreme Court, lower courts and federal and state legislatures have failed
in their duty to preserve, protect and defend the constitutional property rights of American landowners.

The Congress and the courts have allowed the regulators
to run rough shod over the sacred rights to own property.
This breaking with the Founding Fathers must come to a legal end,
before landowners rise up, en masse, against the regulators.

A landowner cannot DEFEND property rights if they don't UNDERSTAND property rights. We strongly urge the reader to click on the following link and study more in depth information on property rights, the "right to exclude" and the "takings" clause. (5 legal sources)

ACPRPF GOALS AND OBJECTIVES

PROPERTY RIGHTS DEFENSES AND OFFENSES

DEFENSES

1. Using the "Power of the Many" to convince government, local, state and federal, that they have taken land use and environmental regulations too far and have exceeded their constitutional authority. Many of the laws and regulations government has passed against landowners, are blatantly unconstitutional.

2. The massive application of the fundamental "right to exclude" by landowners . (this will be one of our major focuses to defend property rights) To read about the power of the "Right to Exclude" we strongly urge you to read Article No. 2 HERE. This "Right to Exclude" clause is included on our "Revocation of Implied License" No Trespass sign. To learn more click HERE. Our "Revocation of Implied license", "Right to Exclude" No Trespass signs works just as well on your home in the big city, as it does for the most rural landowner.

3. The massive application of the "Revocation of Implied License" of government agents and law enforcement from trespassing on your land. This "Revocation of Implied License" clause is also included on our "Revocation of Implied License" No Trespass sign HERE.

OFFENSES

1. Coordinated opposition by landowners at state, county and city council meetings against existing and proposed regulations employing members and ACPRPF Chapters.

2. Establish a legal defense fund to take on the government, defending the "right to exclude" and other issues.

3. Legal challenges against the mis-application of the, "standing", "ripeness", "jurisdiction" doctrines and the, "substantive due process" clause and "substantially advances a legitimate state interest" doctrine, when government regulations "go too far."

4. A coordinated, on a massive scale, civil disobedience if all other legal attempts fail.
